SpaceMonk — Facility Management ERP

These terms are published by PharmacyOne Network Private Limited.

1. Acceptance of Terms

By downloading, accessing, or using SpaceMonk, you agree to be bound by these Terms & Conditions. If you do not agree to these terms, do not use the application. These terms constitute a legally binding agreement between you and PharmacyOne Network Private Limited.

2. Definitions

• "App" or "SpaceMonk": The SpaceMonk mobile application.
• "Company", "we", "us": PharmacyOne Network Private Limited.
• "Organization": An entity that has subscribed to SpaceMonk services.
• "User" or "you": An employee or authorized representative of a subscribing Organization.
• "Administrator": The Organization's designated person who manages accounts and settings.
• "Services": Facility management features provided through the App.
• "Account": A user account provisioned by an Administrator.

3. Service Nature and Account Access

SpaceMonk is a business-to-business (B2B) software-as-a-service application. Access is granted only to employees of subscribing Organizations. Accounts are created and managed by the Organization's Administrator — there is no self-registration. Access is contingent on the Organization's active subscription. The Organization determines which employees receive access. If the Organization terminates its subscription, all associated accounts are deactivated.

The app is distributed as an unlisted app on the Apple App Store and is listed on the Google Play Store.

4. Eligibility

To use SpaceMonk, you must:

• Be at least 18 years of age.
• Be an authorized employee or representative of a subscribing Organization.
• Use the app solely for legitimate business purposes.

5. Use of Services

SpaceMonk provides the following facility management services:

• Inventory tracking
• Asset lifecycle management
• Staff and HR management, including attendance via facial photograph
• Operations and delivery tracking
• Maintenance and breakdown management
• Facility oversight dashboards

The app is mobile-only and designed for smartphones. Use of the app must comply with the Organization's policies and all applicable laws.

6. Device Permissions and Consent

• Camera: Required for attendance photo capture. By using the attendance feature, you consent to your photograph being captured and stored.
• Location: Required for geofenced attendance verification, route tracking, and facility check-ins. By granting location permission, you consent to GPS data collection during active use.
• Push Notifications: The app may send notifications for operational alerts, shift reminders, and maintenance updates via Firebase Cloud Messaging.

Permissions may be revoked at any time via your device settings. Doing so will limit the functionality of the associated features.

7. Facial Photograph Terms

By using the attendance feature, you acknowledge and agree to the following:

• A photograph is captured via the device camera each time you perform an attendance check-in or check-out.
• The photograph is transmitted to and stored on the Company's secure physical hardware servers.
• No facial embeddings, biometric templates, or facial geometry data are extracted from the photograph.
• The photograph is used solely for attendance verification.
• Retention and deletion of photographs are governed by the SpaceMonk Privacy Policy.

You acknowledge and consent to this process as a condition of using the attendance feature.

8. User Responsibilities

As a user of SpaceMonk, you agree to:

• Maintain the confidentiality of your account credentials.
• Use the app only for authorized business purposes.
• Provide accurate information.
• Comply with the Organization's policies.

You shall not:

• Access other users' accounts or data.
• Reverse-engineer, decompile, or extract the source code of the application.
• Transmit malware or harmful code through the app.
• Use automated tools to scrape or extract data from the app.

You are expected to report any security vulnerabilities to the Company promptly at support@1pharmacy.io.

9. Intellectual Property

SpaceMonk and all content, features, and functionality are owned by PharmacyOne Network Private Limited. The SpaceMonk name, logo, and marks are trademarks of the Company. You receive a limited, non-exclusive, non-transferable, revocable license to use the app for its intended business purpose only.

10. Data and Privacy

Your use of SpaceMonk is subject to the SpaceMonk Privacy Policy, which describes how we collect, use, and protect your information. The subscribing Organization may have additional data policies that apply to your use of the app.

11. Disclaimer of Warranties

The app is provided "as is" and "as available" without warranties of any kind, whether express or implied. The Company does not warrant that the app will operate without interruption or error, that data will be accurate or complete, or that the app will meet all of the User's requirements.

12. Limitation of Liability

To the maximum extent permitted by applicable law, the Company shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising out of or related to your use of SpaceMonk. The Company's total liability for any claims arising under these terms shall be limited to the amount paid by the subscribing Organization in the 12 months preceding the claim.

13. Indemnification

You agree to indemnify and hold harmless PharmacyOne Network Private Limited from and against any claims, damages, losses, or expenses arising from: misuse of the app, violation of these terms, violation of any third-party rights, or violation of applicable laws.

14. Termination

The Company or the Organization's Administrator may terminate your access to SpaceMonk at any time. Upon termination, your right to use the app ceases immediately. Data deletion following termination is governed by the SpaceMonk Privacy Policy. The provisions regarding intellectual property, limitation of liability, indemnification, and governing law shall survive termination.

15. Governing Law and Dispute Resolution

These terms shall be governed by and construed in accordance with the laws of India. Any disputes arising out of or in connection with these terms shall be subject to the exclusive jurisdiction of the courts in Bengaluru, Karnataka, India.

16. Changes to These Terms

The Company may modify these terms at any time. Changes will be posted on this page with an updated effective date. Subscribing Organizations will be notified of material changes. Continued use of SpaceMonk after changes are posted constitutes acceptance of the revised terms.
